These Terms of Service (“Terms”) govern your access to and use of NurseMove websites, apps, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms and our Privacy Policy.

Agreement to terms

These Terms form a binding agreement between you and NurseMove. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

If you do not agree, do not use the Services.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Services. The Services are intended for professional use by healthcare workers, employers, and related stakeholders.

Accounts and security

  • Provide accurate, current information and keep it updated.
  • Maintain the confidentiality of your login credentials and restrict access to your account.
  • You are responsible for activity under your account.
  • Notify us promptly at [email protected] if you suspect unauthorized access.
  • We may require identity or employment verification for certain features (for example, employer posting).

Healthcare workers and employers

4.1 Healthcare workers

You agree that profile information, credentials, and application materials you submit are accurate to the best of your knowledge. Misrepresentation of licenses, experience, or identity is prohibited.

4.2 Employers

Employers must post lawful, truthful job opportunities and comply with applicable employment, equal opportunity, and advertising laws. You may not post discriminatory, misleading, or fraudulent listings. Employer accounts may remain pending verification before certain posting privileges are enabled.

Jobs, applications, and recruiting

  • NurseMove is a marketplace and software platform. Unless expressly stated otherwise, we are not the employer for jobs listed on the Services.
  • Hiring decisions, screening, interviews, offers, compensation, visas, relocation, and onboarding are between candidates and employers (or their agencies).
  • We do not guarantee job placement, interview volume, response times, or hiring outcomes.
  • External “Apply” links may take you to third-party sites; those sites have their own terms and privacy practices.
  • You authorize us to process and transmit application materials you submit to the intended employer or posting destination.

Breakroom and user content

“User Content” means content you post, upload, or share through the Services (including profiles, posts, comments, messages, and media).

  • You retain ownership of your User Content.
  • You grant NurseMove a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute User Content as needed to operate and improve the Services.
  • You are responsible for User Content you share and for obtaining any rights needed to share it.
  • Do not post content that is unlawful, harassing, defamatory, discriminatory, deceptive, infringing, or that discloses others’ confidential patient or personal information without authorization.
  • We may remove or restrict content or accounts that violate these Terms or create risk to users or the platform.

Prohibited uses

You agree not to:

  • Violate any law or third-party right
  • Scrape, harvest, or systematically collect data from the Services without written permission
  • Interfere with or disrupt the Services, including by introducing malware
  • Attempt to gain unauthorized access to accounts, systems, or data
  • Impersonate another person or misrepresent your affiliation
  • Use the Services to spam, phish, or send unsolicited commercial messages
  • Circumvent access controls, rate limits, or security features
  • Use automated means (bots, scripts) to interact with the Services except through documented APIs we expressly permit

Intellectual property

The Services, including software, design, trademarks, logos, and original content (excluding User Content), are owned by NurseMove or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from our materials except as allowed by these Terms or with prior written consent.

Third-party services

The Services may integrate with or link to third parties (for example, Google sign-in, payment processors, or external career sites). Your use of third-party services is governed by their terms and privacy policies. NurseMove is not responsible for third-party services.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, NURSEMOVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT JOB LISTINGS OR USER CONTENT WILL BE ACCURATE OR RELIABLE.

NurseMove does not provide medical, legal, immigration, or employment advice. Any visa, relocation, or credential guidance on the platform is informational only.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NURSEMOVE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO NURSEMOVE FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless NurseMove and its affiliates from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Services, your job postings or applications, or your violation of these Terms or applicable law.

Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if we discontinue the Services. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive termination.

Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. If changes are material, we may provide additional notice. Continued use after changes become effective constitutes acceptance of the updated Terms.

General

  • Governing law: These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, unless mandatory local consumer law provides otherwise.
  • Dispute resolution: Courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms, except where prohibited by applicable law.
  • Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and NurseMove regarding the Services.
  • Severability: If any provision is unenforceable, the remaining provisions remain in effect.
  • No waiver: Failure to enforce a provision is not a waiver of the right to do so later.
  • Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
